Hello, I was perusing my local online mugshot gallery and came upon this:

His charges are "ILLEGAL POSS ASSAULT" and "HIGH CAPACITY MAGS".

Just posting this because I keep reading "how many people have been arrested for high capacity magazines", and was interested in some conjecture.

As Bill has pointed out many times, a "hi cap mag" charge is usually an add-on to other charges, not the main charge. This looks to be the case here.

Not enough information. Could be a "valid" arrest due to an actual AW possession, but the magazine charge could potentially be invalid.

Any idea where I could dig up more info? The High Cap charge surely couldn't be posession, I'm wondering if it was manufacturing, offering for sale, etc. Strange charge to add on to posession of an AW..

I agree.

I wouldn't be surprised if the hi-cap mag law is commonly misapplied for mere possession.

An interesting note is that he was booked in December of 2009 and it looks like he has yet to be sentenced.

May not have been convicted.

Seems to me that they charge with everything but the kitchen sink hoping that at least one charge sticks. Or, if all charges are on shaky ground, they can drop the "extra" charges in exchange for a guilty plea on the legitimate charge.:TFH:

After you have been found guilty or plead no contest, you can get it removed for $24. If the charges are dismissed or your found not guilty...no charge, just email the webmaster with your name and case number...

It looks like the case was resolved as a misdo back in 2010. As for the charge, I don't know.

There must be a lot of idiots out there since iirc, less than five percent of "assault weapon" owners actually registered...

Did anyone else the see the "offensive words" charge? Fighting words or cuss words? They booked five people on it. There sure are a lot of ways to get into trouble in CA, the charge list for OR isnt near as long....

Also I noticed the heavy preponderance of facial hair among the mug shots. I wonder if a change in grooming habits is in order. Perhaps my van dyke isn't the hippest thing right now. :)

I think it is disgusting that they post booking photos of arrested suspects publicly. the suspects are presumed innocent. plastering their faces on the internet undermines that presumption.

But there's only one shown, click on driving on suspended license and you get a whole page, so there's only High Cap Mag in their system.

I run across a number of people whom I suspect have an unregistered AW and who could have very well registered, if they had only known...

Usually means "Addtional count", meaning it was added on as a charge along with something else (but there appear to be no other charges [could have been dropped]). After you read official court sentencing docs for a while you realize that there is no standardization among the counties in California and only a few use the same format.

Without the actual number of the Penal Code its kind of hard to tell exactly.

There's nothing in the link to indicate she was beaten, she was arrested for public intoxication, so she very well could have fallen and injured herself or something else.

I think going from a joke done in poor taste to "you think beating women is funny" is a bit of a stretch.

For the record, I didn't think it was funny either.

As crazy at it sounds, Bigamy IS illegal in all 50 states.
The penalty in CA is a $10,000 fine and up to a year in Prison. Some states it can be up to 5 years. :eek:

CA PC 283

281. (a) Every person having a husband or wife living, who marries
any other person, except in the cases specified in Section 282, is
guilty of bigamy.
(b) Upon a trial for bigamy, it is not necessary to prove either
of the marriages by the register, certificate, or other record
evidence thereof, but the marriages may be proved by evidence which
is admissible to prove a marriage in other cases; and when the second
marriage took place out of this state, proof of that fact,
accompanied with proof of cohabitation thereafter in this state, is
