Paul's in direct communication with Ed at the capitol and can only occasionally post/email. he asked me to communicate the following.

Mike
-----------
To All:

Your efforts remind me of a couple of my favorite excepts from Shakespeare's HENRY V

================================================
Once more unto the breach, dear friends, once more........................

We few, we happy few, we band of brothers;
For he to-day that sheds his blood with me
Shall be my brother; be he ne'er so vile,
This day shall gentle his condition;
And gentlemen in England now-a-bed
Shall think themselves accurs'd they were not here,
And hold their manhoods cheap whiles any speaks
That fought with us upon Saint Crispin's day.
================================================

This is the last day of this two-year legislative session.

No one can say that the NRA Members' Councils of California didn't take the fight to the legislature, because we did.
No one can say that the NRA Members' Councils of California weren't organized and effective, because we were -- and are.
No one can say that the NRA Members' Councils of California didn't push until the end, because we will.
No one can say that the NRA Members' Councils of California weren't on the offensive in 2006, because we have been and have two pro-gun bills (signed into law) to prove it.

And no one can say that Ed Worley and I, and the NRA leadership, is not extremely proud of your efforts, because we are!

No matter what happens today, you have fought for the Second Amendment and the NRA and make us all proud.

The legislature is now back in the Capitol and we are in the final hours. Anything can happen. Last night, your efforts (led by Ed's direction) held AB352 on the Assembly Floor on multiple votes. It will be back today!

We will focus our efforts for maximum efficiency.

Please call the following legislators and ask them to OPPOSE AB352!

Name -------------------------- Sac office
Joseph Canciamilla ----------- (916) 319-2011
Shirley Horton---------------- (916) 319-2078
Gloria Negrete McLeod ------- (916) 319-2061
Tom Umberg ----------------- (916) 319-2069
Leland Yee ------------------ (916) 319-2012

IMPORTANT NOTES:
- Tom Umberg switched his vote to a "YES." Urge him NOT TO SUPPORT AB352
- Leland Yee switched his vote to a "NO." Urge him to continue to OPPOSE AB352
- The others have not supported AB352. THANK THEM and urge them to continue to OPPOSE AB352

<<< CIRCULATE THIS MESSAGE TO ALL GUN OWNERS SO THEY CAN HELP IN THIS EFFORT >>>

12:05 PM UPDATE from Paul:

To All:

Please call Assemblyman Simon Salinas of the 28th District (from the following counties: Monterey, San Benito, Santa Clara, Santa Cruz) at his Capitol Office number (916) 319-2028.

Assemblyman Salinas has not been on our side of AB352, but we might be able to convince him to remove his support if we are polite, informative, persistent, and (did I mention) polite.

AB352 information available at
http://nramemberscouncils.com/legs.shtml?summary=ab352&year=2006 .

1:47 PM PST UPDATE

AB2714 has just been voted out of committee and is back on the Senate Floor for an expected vote today. Please call the Senators and urge them to vote NO on AB2714.

To All:
10:00 PM UPDATE

To All: AB352 just went down AGAIN!!!!!!!

The vote was 35 YES --- 33 NO

The bill is "on call" so this fight is NOT OVER.

NOTE: This is NOT the time to give-up, let-up, or get cocky.

Thanks for all of your efforts.

Paul

P.S. Don't forget that AB2714 will probably come back to the Assembly soon.

-----------------------------
UPDATE 10:39 PM PST

And again, AB352 went down. This time, 39 -- 32.

KEEP UP THE PRESSURE!

Paul

-----------------------------
UPDATE 10:38 PM

And again, AB352 failed with a 38-34 vote (41 needed).

Remember, NRA MEMBERS' COUNCILS DON'T QUIT UNTIL AFTER THEY ALL TURN
INTO PUMPKINS AND GO HOME!

Paul

-----------------------------
UPDATE 12:32 AM

To All:

Thank you for all of your efforts. You did G R E A T !!!

AB352 died a death of a thousand cuts, with Koretz trying every trick
in the book, but failing in the end. :-D

A couple of bills did pass and they now go the Governor's Office. We
will advise everyone on the strategy for veto requests soon.

Thanks again. You all should be very proud of yourselves.

It was kinda funny.

This is what we want! We want them pissed that whenever there is anti-gun legislation we will innundate them with phone calls, emails, faxes and letters!!

Just called, the guy answering the phone didn't seem too enthused to hear that I was asking the good Assemblyman to oppose AB352.

"Are you one of Assemblyman Salinas' constituants?"

ME: "No, I'm not. And that shouldn't matter, because this is an issue that impacts ALL Californians, not just the ones in his district."

I wouldn't have spent my $$$ for a phonecall from Iraq to Sacramento if I thought it was a trivial issue.

You're exactly right. In fact, allow me to quote one of Paul Payne's articles at http://nramemberscouncils.com/tip-email.shtml
"...If they complain that they are not your legislator, inform them that you will continue to contact them as long as they continue to vote on Second Amendment issues that affect you..."
I guess it's true - great minds DO think alike! :-)

He said, I suppose your against this bill.

I said , yes and have you been getting alot of contact about this bill.

He said, The phone has been busy all day.

I said, for or against.

He said, against.

He then took down the info and said, I will pass along your opposition to this bill. But I can't guarantee he'll change his vote.

Guys I hate to chime in and say something positive about Koretz but I do respect how passionate he is and how hard he fights for his bills. Despite a long series of rejections on this bill he is extremely passionate about it and is fighting to the very last minute to get it passed.

Yeah, I believe this is really nothing more than a veiled attempt to ban semi-auto handguns... but like I said Koretz is one of the hardest anti-gun fighters I've seen since Perata fought for SB-23.

From The Life Cycle of a Bill - after passing both houses:

6. Governor
The bill then goes to the Governor. The Governor has three choices. He or she can sign the bill into law, allow it to become law without his or her signature or veto it. A governor's veto can be overridden by a two-thirds vote in both houses. Most bills go into effect on January 1 of the next year. Urgency measures take effect immediately upon being signed by the Governor and chaptered by the Secretary of State.

7. Secretary of State
Bills to become law are sent to the Secretary of State for final review for accuracy. Each bill is given a chapter number and the Secretary of State stamps it with the Great Seal of the State of California.

2728 is non-urgency, so it would go into effect on 1/1/07.

hoffmang
08-31-2006, 10:00 PM
Now that 2728 has passed, I think we can talk a little more directly about it.

1. Pinned mags or gripless guns are not Assault Weapons.

2. In most counties, having an AW is 9 times out of 10 going to be a less than $300 fine and the weapon taken.

3. No more guns will ever be declared Assault Weapons in the future. Want to buy a Sig-556?

4. If we need a veto on some other - far more foul bill - the Governor can point to this Anti Assault Weapons bill and say that he's for sensible gun control but that some other more important thing that gets through was too much.

Bottom line: Don't bug the governor on 2728.

08-31-2006, 10:09 PM
I think 2728 is really insidious. Previously, if there was question whether or not someone had an AW, a DA would be reluctant to prosecute a felony case. It costs a lot to do so, and may set precedents on appeal. Most would not want to try a "grey area case".

However, if a bunch of folks are rounded up with a "grey area" AW, they will now be offered a chance to plead to the infraction. Lose the gun+$300 bucks vs. spending thousands on lawyers and rolling the dice on a felony charge. While there are some well-pricipled, well-heeled folks here that would fight the good cause, I'll bet the average joe would just pay the fine and give up the gun.

The legal framework for confiscation program is now in place. This is seriously bad as far as I'm concerned.

Nuisance seizures don't create precedent. Also, there are quite a few who would not care to give up a $1000 AR. I know Ben said he'd be a fighter. I think the better part is that this keeps guys who don't build a correct OLL out of jail and with their gun ownership and purchase abilities in tact.

I think 2714 was back in the Assembly for concurrence.

First, Haynes wanted it moved to Judiciary, then he withdrew his motion. Torrico and La Suer spoke, it then went to a vote, resulting in concurrence with the Senate amendments.

Big question is what was changed in the Senate? Guess we will have to wait to see the bill.

It could just be due to the 8/24/06 Senate amendments, similar to what happened with AB2728, where it had to go back to the Assembly.

4. If we need a veto on some other - far more foul bill - the Governor can point to this Anti Assault Weapons bill and say that he's for sensible gun control but that some other more important thing that gets through was too much.

Bottom line: Don't bug the governor on 2728.

-Gene

The problem with not bugging the governor, is that he and his people are extremely sensitive to public displeasure. I'll bet they'd view a lack of bugging them as evidence that no one has a problem with 2728. Then, he'd be less likely to strongly oppose another bill that you thought was too much. Start putting the pressure on now, rather than seeming to come out of nowhere on a later bill.

Paul asked me to express his and Ed Worley's thanks for your incredible support this year (me too) and to expect strategies and tactics on how to continue to fight the remaining issues soon.

I'm now in the process of updating...
