View Full Version : AR Pistol/ Legal Questions

In looking at the penal code definitions under 12276.1 which covers pistols, it says;

(4) A semiautomatic pistol that has the capacity to accept a detachable magazine and any one of the following:
(A) A threaded barrel, capable of accepting a flash suppressor, forward handgrip, or silencer.
(B) A second handgrip.
(C) A shroud that is attached to, or partially or completely encircles, the barrel that allows the bearer to fire the weapon without burning his or her hand, except a slide that encloses the barrel.
(D) The capacity to accept a detachable magazine at some location outside of the pistol grip.
(5) A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 10 rounds.

My question concerns (A) and (C). First, are the people building these pistols welding/ perm attaching a muzzle brake? If its permanently attached, can it be a flash suppresor?

Finally, how are the hand guards not considered a "shroud" or a second grip?

I have no desire to build one, but I would really like to get a PPS43 if there is a way to do it legally.

I tried searching but didn't really find the answers I need.

most of those people are running "fixed mag" so (4)(A-D) don't even apply. Only have to worry about (5) then.

look at the pistol AW flowchart for more info on how all the laws interact.

Yep thats what I was missing. I knew it was a simple answer. It just wasnt clicking with me. I sometimes forget about the whole fixed mag thing (I don't have any) and how it nullifies most of the rules.

No dumb question. Could have been a dumb action if you built a pistol in the wrong way. Always better to ask then to go to jail! :eek:

ps: it is always better to ask questions on a website (like this one) where noone knows you and run the risk of looking dumb, than to build a illegal weapon, go to jail and end up on the news looking dumb in front of everyone :D
