View Full Version : Need help with Auction Purchase

I won an M1 carbine on GB last week, sent a copy of my C&R and my check, followed up with an email and everythis was fine.
Today to seller calls me and is leary about shipping tome in CA. He too has a 03FFL. He is very helpful, just wants to stay within the law (of course) and was told by his 01FFL buddy that the carbine must be shipped to an 01FFL here. He was told he cannot ship directly to me. I have received many C&R rifles directly by mail so I know it can be done.
So my question is can someone tell me where I can find paperwork to send him stating that it is ok for him to ship to me? It needs to say that he can ship to CA or he wont do it. All of the info I have sent him has helped but not solved the problem yet.
Like I said, he is a very understanding guy and wants to help, he just needs some proof that it is legal, he is very leary of CA law.

Email him a copy of the Assualt Weapon flowchart. It's sticky'd on one of the forums.
It's perfectly legal for him to send you the carbine. If it comes with magazines over 10 rounds he must disassemble them. You may not reassemble the mags unless you pin them at ten rounds.

You need to show him two things. One that it is OK to ship a C&R rifle to another 03. And that it is OK to send the magazine if disassembled. If I find the pertinent links, I'll post.

How about contacting GB to have them affirm shipping a C & R eligible long gun directly to an O3 in CA is legal?

He's asking you to prove a negative - as in, show me the law that says it's not illegal - and that's impossible. You could show him the law regarding C & R handguns and say "now if CA restricted C & R long guns as they do C & R handguns - don't you think there'd be a law .....?"

I just went through the same thing earlier this week and I did some research and saved the links I found. Here they are:

This is the CA DOJ website where they explain that all firearms have to go through an 01FFL, but antiques and C&R are exempt. It's question 14:

Ok, so with that done... the reason out of state Sellers complain about shipping to CA is because of the CFLC program, which requires them to get a shipment approval number each time they ship firearms into California. The CFLC program specifically exempts 03 and 06FFLs from having to participate in this program. Here is the CFLC FAQ, it's question #4:

Finally, here is a bulletin from when the CFLC program came out, and this also shows C&R is exempt (towards the top of the second page):

This info worked for me and I am expecting some cool stuff next week :)

That is some great info and I have forwarded it on to my seller along with a link to this post. I have read trig questions that are easier to understand than CA gun laws.
