yes, it most definatly would be, since the ATF does not seem to be in the habit of actually knocking or anything.

Actually I think it would be more of a team effort. Kind of a joint task force thing. Of course, it's the ATF that brings the tanks.

Don't forget the Federal Gov't has killed people because of short barreled shot gun........

And wiped out a entire camp cause they thought the had a few illegal weapons.....

I feel safer because of it..............

Is there any added penalty (legally) of being caught with an SBR compared to a non compliant built OLL?

I know that both would be considered assault weapons, however does the SBR come with its own added charges?

I know itís a stupid question, but again itís a hypothetical one.

Well, without digging up the penal code, (going off memory) the penalty for an unregistered SBR is 2,4, or 6 years in a california state prison. Federally its a 10yr sentence in a fed prison... USUALLY the BATF takes the case on federal stuff like SBRs...

Basically, don't do it :)

Well, let's say you had an OLL built up into an (illegal, unregistered) AW.
Let's also say it had a 11.5" barrel.

They could line up all sorts of charges... here's what they _could_ do:
simple unreg'd AW possession (misdemeanor/felony wobbler);
illegal AW manufacture;
illegal AW transport (esp if you drove it- they might allege it anyway);
illegal SBR possession; (CA)
illegal SBR manufacture; (CA)
multiple Federal SBR charges;


In theory you could get 10-20 years if all the charges' penalties were consecutive and nothing was plead down, etc. and if both state and Fed went after you.

Stay legal. If you really want an SBR THAT badly, move out of state.
