Spoke to My Sheriff, DA, Deputy DA Investigator Today, and all three returned my calls. My DA is clueless about AW’s and relies on DOJ for testing and expertise and goes by what they say for any court proceedings about AW's. The Investigator just gathers the facts for the DA. I got the felling that the DA sort of yawned about the whole OLL thing and would not push the issue unless it was force upon by arrest.
Now where the rubber meets the road is my sheriff, after a long discussion he wants me to come down and present to him and his WO/RO a more in depth OLL briefing. He didn’t seem to have any problem with OLL wants to see ALL of the DOJ Memos and other Doc that I can gather here. I have #3 & #4. Could someone show me where #1 & #2 are?
BTW my Sherrif if pro gun rights.

Good for you man. My thoughts are that my Sheriff is ok with it too, but I will talk to him face to face before I put words in his mouth. I'm also glad to hear they let you plead your case before they shut down the conversation.

Are you taking just documents or a rifle too?
Just a word to the wise. It is an old tactic for a law enforcement officer to ask you to come to the station to talk and then arrest you when you get there.

That said, I'm sure the DA and the courts wouldn't be very interested in prosecuting a case where a law abiding citizen was "invited" by the sheriff to discuss the issues related to building a legally possessed firearm but then arrested because the sheriff is tricky tricky. hehe
EDIT: IMO worst thing that will happen is the sheriff will ask you to epoxy your magazine / remove your pistol grip and don't ever let him or his deputies catch you with a illegally built rifle...

It sounds good, but be careful not to incriminate yourself. There is a reason why we have a right to remain silent. I would absolutley NOT bring in a rifle to show them what you have built.

Either way, I'm not sure this was the brightest idea ever. Everyone keeps trying to call attention to whats going on, in desperation hoping they can circumvent the DOJ by instead being taken under the wing of a local law enforcement agency. Don't count on it.

I don't think anyone is trying to circumvent DOJ. If I know my local LEO and DA know the law the right way, and especially if I can get a letter from them, I'm pretty safe from prosecution.
I'd like that.
If we all can get a county by county split on what is or is not legal, we have some interesting actual proof about SB23 being infirm.

Frankly, if presented properly, this is a great idea. Most DAs have bigger things to worry about, and this could save some poor sap from being fed through the ringer simply by education alone.
I would speak only in GENERAL TERMS (say "people have been doing X" not "I did X") and absolutely do not bring a rifle.
The explination is relatively simple for those of us familiar with the statute and case law on the matter, but actually very complex for outsiders.
E-mail me if you are looking for forms, or for someone for your Sheriff to call (please don't waste my time with underlings or Deputies though, no offense to any Deputies out there.)

Sure, it would be great, provided we get positive reactions from LE agencies.
It will only hurt us though, if the DOJ is suddenly getting calls from agencies all over the place asking them what the hell is going on with all these "assault weapons" being built in the thousands. If that were the reaction, it would bolster the DOJ even more in trying to screw us over with legislation or more stupid definitions.
If we're going to start calling more people to jump into this fight, lets just hope they're all going to be on our side. In a state like this, we sure as hell don't need any more opposition.

Except for the fact that recent evidence suggests they're going to try a new technique that will stop them from coming in, and also stop us from being able to do anything with them.

Well, DOJ will try for new legislation and they will make new regulations, they've already said that.....
Plus, it might be a good idea to see where they stand on one side or the other......keep people out of unnecessary trouble.
Hopefully this will set a precendent for more action so we don't have to worry about all 58 DAs.

That's the impression that I got from the DA, he didn't want to know about AW's as he had other fish to fry. If the sheriff brought him something then he would look at it. If we educate the LEO's that we are resposable and law abiding gun owners we will have them on our side. My county in a play ground and the potential for a LEO encounter is possible. My sheriff had no idea that OLL's were even possible and wants to understand the whole picture. I get the feelling that he's a little pissed that Sacramento has not been doing thier job and now droped another rock in the road on strained county funds.
He also told me not to bring a rifle or a lower, this is and education meeting, and I think I will ask for some kind of "stay out of jail letter on my OLL rifles" while I'm there.

Take in some pics with the various configurations and maybe show the laws that support that particular configuration. include the SRD and the various kits to lock the mag (and require a tool ).
I think this is a great idea. These are the people that will be holding you or letting you go, never mind the DOJ or the DA.

My Sheriff is PRO Gun rights and issues CCW's he's on our side and he also has a job to do. i don't think he wants a test case in his county.

I'm glad the sheriff is getting the info from you rather than from a member of the Brady Bunch! Good job. Give us an update after your meeting.
Also, offer to be on call as the "County AW Verification Officer".
