 Ok, I got one of these from Traders awhile back with some flares

Question is I want to test fire a flare to make sure it works. Is there any legal restrictions on shooting a flare?
Thanks

Might be a good idea not to fire one off in your backyard or at approaching aircraft. :D Sorry could not help it.

I've been sailing at night outside the gate, its pretty common to hear someone get on the radio to warn nearby boats that they are going to practice shooting a flare. I dunno about the restrictions on land, but if you have access to a boat and warn people that you are not trying signal an emergancy...

I think the fireworks prohibition applies on land.
If you want to test, shoot in your pool? Otherwise go for sea.

Do NOT shoot one over water. Doing so is a false emergency, and could get you into a LOT of trouble... From what I have been told, it is a felony.
Find a nice deserted spot off I-5 or something.

HAH i was just about to say that!!!! DO NOT SHOOT IN WATER!!! Oh god those things are pretty loud too. It kicks like a 12 guage. A buddy of mine actually tried shooting it horizontally and the damn flare landed on the groundl. Almost started a fire. They are fun to have. I dont know about the legality though. Just please be careful!!!

Here is something about legality (mostly federal)

Basically, if you've got the wrong kind of ammo, its a destructive device.

I think he was talking about the (handgun) type H&K 26.5 mm flare gun.
