What is the California law regarding loaning a Handgun to a family member with no felonies etc... What is the law regarding using it for protection if required by that family member.

My uncle recently ran into trouble with some bad people at his place of business. Turns out one has a prior major felony and threatened him. There is a long story behind this I dont care to discuss. He is going to get a pistol tomorrow but in the next 10 days I am worried about him and his families saftey.

Does your uncle have a HSC?

He has to have the HSC in order to borrow it. And cannot borrow it for periods greater than 30 days or something like that.

Agreed.... but given the nature of the situation, I would get a commitment that he will compensate you for the loss of the gun in the event he has to use it and the police confiscate it.

I'm more worried about my family than a firearm. He will have the hsc tomorrow and be starting his 10 day

Once he gets the HSC you can loan him the gun for up to 30 days.

This is correct.

Here is what the penal code says:
12078.
(d) (1) Subdivision (d) of Section 12072 shall not apply to the infrequent loan of firearms between persons who are personally known to each other for any lawful purpose, if the loan does not exceed 30 days in duration and, when the firearm is a handgun, commencing January 1, 2003, the individual being loaned the handgun has a valid handgun safety certificate.
