If not tomorrow morning, it's gonna be a loooong weekend.

I was just perusing my copy of 07-290.pdf (Heller) so I know what to look for... hoping I get to read

Held:

1. The 2nd Amendment is applied to the states through the PoI clause of the 14th Amendment

It's likely not to be released until next Monday. If it's not in scotusblog by ~11am tomorrow that would be a pretty safe bet.

We need to start making up the lyrics to "Old McDonald Had A Gun!"

E i E i O!

And once he did he had some fun!

E I E I O!

With a bangbang here and a dead goblin there,

Dead thug no mug right upside the head thug

E I E I O!

And old man Daly cried some tears.

E I E I O!

No more votes by raising fears!

E I E I O!

With a table fulla junk and threats,

E I E I O!

I nominate Kestryll, Hoffmang or Bwiese to be the one posting the opinion here. Otherwise, we'll have 20 different posts here, a dupe here and a dupe there and everywhere. No, I won't be posting it, I learned that lesson the hard way once already...:)

Agh! What rock have you been hiding under?

Lots of threads here, and see also the web site (http://www.chicagoguncase.com/) Alan Gura has for the case.

In very short, McDonald will probably apply the 2nd Amendment as a constraint on other levels beyond the Federal government. That would mean that suits in state court cannot be thrown out because some judge thinks the 2nd Amendment does not apply to states.

SCOTUS BLOG:

The Court will issue opinions at 10 a.m. Eastern, and we will provide live coverage. We do not expect any orders.

Afterward, the Justices will meet for their private conference to consider petitions for certiorari and motions in pending cases. Orders from that conference should be announced on Monday, June 28. Our list of Petitions to Watch for that conference is here.

It's kinda funny how a law-altering historic decision is only an opinion. Sometimes people tell me mine aren't worth very much, yet because it's 5-9 people somehow it's magical.

5-9 people with law degrees who have spent decades pouring over the details, history and minutiae of Constitutional law and prior judicial decisions and then spend months formulating their own.

And you are upset that their collective opinion is valued more highly than yours?

From SCOTUS BLOG:

Anna:
Good morning and welcome to SCOTUSblog's "live" coverage of opinions at the Supreme Court this morning.

Anna:
This morning's session at the Court should begin promptly at 10 AM EST. We are expecting opinions, but no orders, today.

Anna:
We will be back shortly before 10 with our reporter at the Court, Lyle Denniston.

Tom:
One implication of RBG's opinion is that it likely leaves Justice Alito with the gun case.

Anna:
We're back, this time with Lyle. We'll have opinions in a few minutes.

Tom:
In answer to questions -- Alito probably has the guns case because that's the last remaining case from March, and he is the only justice not to write in that sitting.

And there are no opinions left for today...

Edited to combine my multiple posts on this page into 1 or 2 at most.

I have a law degree too but right now I'm packing up the truck to take a few friends to a ranch around Shasta for some p-dog vaporizing and long range steel banging.

In other words, nothing is going to change overnight, no matter what the opinion contains, and people should spend time doing the things they enjoy rather than wringing their hands over what the Supreme Court is doing second by second.

10:30 Tom: We should not get guns today if Alito does have it, because Scalia has already gone, and he's more senior. (Good point from the comments.)

Finally, a cue that I can get up from the suspense of watching the live updates.

Unless SCOTUS postpones the release of the decision until the second term that is.

...Ah, just kidding :D

I think they are leaving it for last because they know it will be so controversial that the media will likely be inundated and the clamor will drown out all decisions after it.

The live SCOTUSblog people said SCOTUS doesn't hold decisions, they release when the opinion is written. If true, it really shouldn't take that much work to tell Chicago.gov they are traitors and should go to hell for all the violent crimes they have enabled, and anyone else in the U.S. doing the same will meet the U.S. Marshals Service very soon...

It's kinda funny how a law-altering historic decision is only an opinion. Sometimes people tell me mine aren't worth very much, yet because it's 5-9 people somehow it's magical.

I remember studying cases when I was a 1L (that's as far as i went) and we'd protest to the profs that the opinion often didn't justify the decision. They'd shrug and say, often the decision is made by gut or bias and then the opinion is drafted to try, however weakly or illogically, to justify to the decision. There is no such thing as dicta--it's all dicta ;-)

I think SCOTUS knows what a bombshell the McDonald decision will be so they'll release it last so the media clamor doesn't drown out their other decision in the wake of it.
