View Full Version : FOPA, CA AWB, and AB 1810

I was just reading some gun legislation, and was reading about the Firearms Owners Protection Act. Besides being outraged at how the Hughes Amendment was passed despite a recorded vote claiming otherwise, I came across this portion:

"No such rule or regulation prescribed after the date of the enactment of the Firearms Owners’ Protection Act may require that records required to be maintained under this chapter or any portion of the contents of such records, be recorded at or transferred to a facility owned, managed, or controlled by the United States or any State or any political subdivision thereof, nor that any system of registration of firearms, firearms owners, or firearms transactions or dispositions be established."

Now, it specifically mentions "State", so since federal law supersedes state law, shouldn't AB 1810 be violating this portion of FOPA? Secondly, shouldn't the entire concept of registering AWs be moot? Should the DOJ have to destroy all records of registered AWs?

If you read it carefully that just is about Fed info.

The DOJ required *people* to *file* AW registrations, and this info was not derived from 4473s.

Entirely separate.
