View Full Version : Customer need to know if he needs a lawyer for getting his gun rights back. Know any?

I have a customer who had a misdeamnor assault and battery (swears it was not DV) when he was 18 and that was eight years ago. The hard core judge around here said he would have a ten year restriction on guns. He tried to do a DROS last year and was denied.

Do you think this is an automatic ten year exclusion that will expire automatically or is this something that he is going to have to hire a lawyer to take care of?

Also, I am thinking he might just be able to contact the court and ask them what the restriction was and have them give him the info without having to hire an attorney.

What do you think?

If he needs to hire a lawyer, any suggestions for one around Kern County that might specialize in this and might be reasonably priced? Thanks!

I agree that he should first contact the court and get his case info.

A general N-year exclusion should expire, but it may be "stick" recordswise.

If he can show the conviction date and prohibition time, and thus the expuiry of the latter, the DOJ may just proceed.
