FN seems to consistently call it a brake but I believe it's just the PWS FSC556 which is generally considered a flash hider. (at least in CA). Are they really the same device?

Yes, the stock Muzzle attachment on the SCAR is the same exact thing as the PWS FSC556 (Flash Suppressing Compensator)
It's a brake that reduces flash, which in CA, by definition, could be considered a Flash Hider. It's a borderline topic that gets debated to death, but it would be an uphill battle based on the fact that it has "Flash suppressing" is in it's name.
I wouldn't recommend it on a featureless rifle unless you have an awesome legal team and money to fight it out for the rest of us in this state
