Not any more. Read up on the UDV case (http://www.mdmj.info/node/view/555) recently decided at the supreme court and the "Religious Freedom Restoration Act."

All we need is a Church of the Gun that requires its members to have an alter dedicated to Saint Browning, Saint Kalashnikov, and Saint Stoner and require that members form a collection of the Saint's glorious inventions in their orginal configurations (screw simi-auto).

If they can't shove the Controlled Substances Act down a church's throat, then they shouldn't be able to use the various Federal and State gun laws against the Church of the Gun and its members.

ya know, that's a funny observation. Jesus was a semite, and a carpenter when all tools were hand tools. he would have not been a white, skinny, brunette; think more IDF soldier type in physique.

You should start a church around me - and the rectory will be an indoor range, communion will involve prime rib, and collections will go to NRA and CRPA.

The RFRA is to prevent enforcement of laws against a person that impact someone's religious activities.

RLUIPA is to prevent laws relating to land use from impacting someone's religious activites.

Similar, but there is a difference.

RFRA would be used to get an injunction against the federal government from enforcing machine gun laws against Church of the Gun members who wish to import a full auto AK from Russia as Saint Kalashnikov would want.

RLUIPA would be used to force local government to allow a long distance shooting range on Church of the Gun property regardless of how the property in question is zoned or if it is inside an incorperated area or not.

Much like you can be a Buddhist in addition to being a Christian/Jew/Animist/whetever, being a member of the Church of the Gun does not preclude you from having another faith.

Bill may have different rules in his church though ;)

At the end though, everyone think we're crazy and we'd get raided by the ATF like the davidians.


On the other hand, we would have a hell of alot more firepower than the Davidians did.

The Boerne case ruled that the RFRA was unconstitutional as applied to the State through the fourteenth admendment. As far as I'm aware, RFRA still applies in full to Federal Law. The UDV case previously linked relies totally upon the RFRA and not at all upon RLUPIA. It also only delt with Federal Law and not one bit with State Law.

That is why in my example I used the RFRA to combat Federal machine gun regestration and importation restrictions and used the RLUPIA to fight local restrictions on a firing range.

Do you know of any cases that have used the RLUPIA that have been published? (not picking a fight, I'd really like to know).

EDIT: nevermind, I've found http://www.rluipa.com/, looks like lots of decisions ripe for reading.

What about starting your own denomination of Protestant Christianity which simply makes some affirmative doctrinal statements about the duty of the believer to keep and bear arms?

Organize it like a Baptist church, run Sunday night services, and I'll attend. And I won't just be punching cards, I'll actually be worshipping.

Bweise: You know, when you mentioned running your own church, I just had visions of your eyes flashing, Gould-style from a pulpit... it was amusing.

Nobody has noticed the real irony in the picture. In the traditional picture Jesus isn't carrying a weapon to defend himself with. He's carrying a cross to be crucified (executed) on. The parallel is he struggles with both the instrument of his death and the necessary sacrifice for salvation. Anybody else uncomfortable with the image of getting impaled on a Barrett?
