View Full Version : Shipping a registered assault weapon out of state?

So, I'm thinning out my herd and I'm selling a registered assault rifle that is banned by name to a buyer out of state. (It's an AK, so no, I can't just strip it down and keep the parts) Can I just take it to a UPS and ship? I heard somewhere that I have to do it through a damn RAW dealer. If thats the case, can I just hop the border to arizona and ship from a UPS there?

Only choices are a RAW dealer $$$$$$$$$$$$$$ or drive to a free state and ship UPS

Yea thats what I figured. So retarded. You'd think if I was getting rid of a RAW from the state the DOJ would be happy to let me ship it out from home.

Oh well, guess a trip to vegas is in order.

Why cant he just ship it through UPS? he is the legal owner of it what is the difference?

BTW where are you shipping it to? yourself out of state or a family member or a shop/dealer?

Does the law state that it has to be shipped through a RW dealer? What if you are shipping it in for repair? I know that does not have to do through a RAW FFL. A registered A#W can be shipped by the owner for repair so why not to a out of state FFL? I looked for the law but didn't find anything about it. Only if your shipping to a in-state FFL would it have ot go to a RAW dealer.

Can anyone find the law on this?

They'd be happy to let you. But there are consequences, for which they will jiz themselves for the opportunity to oblige with.

The PC defines specific places that you can possess a RAW and the UPS store is not one of them.

PC 12285(c):
(c) A person who has registered an assault weapon or registered a
.50 BMG rifle under this section may possess it only under any of
the following conditions unless a permit allowing additional uses is
first obtained under Section 12286:
(1) At that person's residence, place of business, or other
property owned by that person, or on property owned by another with
the owner's express permission.
(2) While on the premises of a target range of a public or private
club or organization organized for the purpose of practicing
shooting at targets.
(3) While on a target range that holds a regulatory or business
license for the purpose of practicing shooting at that target range.
(4) While on the premises of a shooting club which is licensed
pursuant to the Fish and Game Code.
(5) While attending any exhibition, display, or educational
project which is about firearms and which is sponsored by, conducted
under the auspices of, or approved by a law enforcement agency or a
nationally or state recognized entity that fosters proficiency in, or
promotes education about, firearms.
(6) While on publicly owned land if the possession and use of a
firearm described in Section 12276, 12276.1, 12276.5, or 12278, is
specifically permitted by the managing agency of the land.
(7) While transporting the assault weapon or .50 BMG rifle between
any of the places mentioned in this subdivision, or to any licensed
gun dealer, as defined in subdivision (c) of Section 12290, for
servicing or repair pursuant to subdivision (b) of Section 12290, if
the assault weapon is transported as required by Section 12026.1.
