View Full Version : talked with a gun attorney today about DOJ memo...

[For now, let's not play a name guessing game of whom I'm talking about.]

On Saturday, as various SHOT Show attendees returned to the Excalibur, I was placed in contact with another big gun-rights attorney thru the graces of a large central valley gun store owner (the store, not the owner!) who was on the same bus. We were standing in the Excalibur casino when this happened. The FFL dialled the attorney on his cellphone, introduced me, the phone was handed to me, and we had a 3 minute conversation while this gun attorney was driving home.

He agreed with me upon my attacks (which were outlined in my rebuttal posted here awhile back) on the recent DOJ memo, and asked me to send him the updated, fleshed out rebuttal I've been working on over the last week or so. [I am going to keep this one private for now.]

He's fairly busy this week, but he forwarded me on to one of his gun attorneys that, it turns out, is helping other members here. This attorney also agreed with my take about tiers, modified registrations, etc. He's gonna try to talk the DOJ out of it but it still could end up requiring an injunction, etc.

Thanks for staying on top of this and not backing down! I'd bet I'm speaking for more folks than just myself when I say that I'm standing by in case there's anything I can do to help us win this fight.

Bill and I both are working on this, with a variety of attorneys. We can't really say more at this point (not hiding anything, it is just premature at this time to make any statements.)

We are hopeful for a positive result.

I think it's EXTREMELY important that we learn form the DOJ's mistake. The lesson we taught the DOJ is that it's better to be proactive than reactive. Hence, attempting to talk the DOJ out of ending up in court and preparing legal breifs now for the possibility of an injuction could only be a good thing.

Hopefully your attorney scored a couple lowers too! j/k :)!

I figure thatll be honor enough, though I need to decide who is the 16" carbine, and who is the varmint setup....

Heck, if we pull this off their names are getting engraved in at least one of my lowers. Ben and Bill are going to become LEGENDARY among various gun owners. There won't be a gun range in the state where people don't know who they are every time they see an off-list lower :D!

This somewhat struck a nerve and I debated on how to reply to your post for about two minutes. After thinking, I recalled a moment during my police academy orientation. I remember the day clearly... it was Saturday, August 28th, 2004 at about 0900. Approaching two hours into orientation, the Chief of Police was speaking to us and used the often heard phrase "You are all only as strong as your weakest link. It may not make sense now, but it will on graduation day." Months later when we graduated with about 28-32 people versus the 54 or so that we started with, it made sense.

I am sure you have all heard the former half of that quote before, but for most of you I doubt it has ever really been applied toward anything you have done in your day-to-day affairs, not even in the corporate world. I will be the first to tell you that it applies here in terms of making a stand to return the rights that should be afforded to us all without question.

From what I have observed, while Bill Wiese is a very capable and competent individual with regards to working toward our cause, he is only one person. The same goes for Jim Marsh. If either ultimately fails in their pursuits, the blame is not to be placed at their foot steps but rather at the foot steps of every single member here and every single lawful gun owner in this state as it is up to us to rally behind individuals like Bill Wiese and Jim Marsh to show our strength and support if we wish to not only maintain what few rights we still enjoy but gain those that we rightfully seek and desire.

So to steal a move from JFK... I ask you all, what have you done lately to assist in reforming firearm laws in California?

I'd buy ya both a case, but I'll need the $$$($?) to a) buy the *REST* of the rifle and b) donate to the legal fund to help these guys get their lowers back so *they* can do a) above.

I'm in SJ near Bill, so I'll deliver his beer, who's got Ben?

Bill, I've been quietly viewing these forums for a while now, and your voice has been a comfort during the occasionally murky process of buying an off-list lower and planning it's build-up. I appreciate your insight, passion, and your willingness to take action. We all know that "talking" with lawyers can cost a pretty penny, so please don't be shy in spreading the cost around. This is a community, and we want to support this effort.
