View Full Version : If I owned Hi-Cap mags for my glock before they were banned, can I use them?

Alright...on my AR-15's I have about a dozen 20 & 30 rd mags that I owned previously to them being banned and reg'ing it as an assault weapon...
Since I owned the mags previous to the ban, I am able to keep and use them with no issues.
On my 45acp glocks I have 5 hi cap magazines that I have owned since I got them back in the early 90's. I haven't used them since the ban.
Am I legal to keep/own/use these if I have owned the magazines since before the ban, just like on the rifles??
any info or specific text from the DOJ laws would help thanks guys

If you owned them prior to the ban, yes you may own and use them.

I have a 2nd question that may be a little more iffy.
I own a nice Beretta 92/M9 that Ive had since the late 80's.
I have a bunch of random mags for it, including several 15 and 17 rd mags, two 30 rd and a 32 rd mag for it as well (long suckers).
These are hi cap mags that I owned pre-ban.
The springfield xd guys commonly use beretta mags because they are cheap and hi-cap.

These mags work in my springfield XD-40 with no problem and hold over 13 and 15 rds of .40 in the smaller mags and about 26 in the largest mag.
Legally can I use these hi-cap mags in my XD-40 with no problem? I legally own the mags...and they are hi-cap mags.
I am not creating a hi-cap mag, it actually holds less than factory with the .40 in it. and the law doesnt specify anything about what ammo is used in it, only that if it holds more than 10 and i owned it preban, then it is legal.
Can someone give some insight into this?

I think as long as you don't have to modify the mags to make them work you are OK.

As was said on other magazine threads: The term "high-cap" is anti speak. These are standard capacity magazines, the way God intended it. ;)

Or if you modified them to fit a new firearm, CA law may want to ensure that the mags still work in the original firearm as well. This was how the Feds ran the opinions when we had the Crime Bill in effect.

I have to say, I dont think God meant for 30 rounders to be stuck in a non full auto pistol.

Are you sure a Beretta 92 mag drops right into an XD? The article you alluded to mentions the dreaded word...
"Interestingly, less expensive Beretta 92/M9 high capacity magazines can be easily modified to be used in the XD."

On beretta mags a hole has to be added to the front of the mag for the mag catch with the xd. But other than that it should work in both the xd and the beretta. Mark
