NRA/CRPA SUBMIT LETTER OPPOSING LCAV GUN CONTROL ORDINANCES BEING CONSIDERED BY THE OAKLAND CITY COUNCIL

This evening at 6:00p.m., the full City Council of Oakland (“OCC”) will consider and vote on whether to adopt amendments to three ordinances that impact the rights of lawful gun owners in that city.

The aggressive package of amendments is the Legal Community Against Violence’s (“LCAV”) most recent attempt at pushing its gun ban agenda locally, while pushing the “envelope” of the legal doctrine of preemption as outlined in the Fiscal v. City and County of San Francisco case (which limits the authority of local governments to regulate firearms and ammunition). LCAV’s last attempt to push these ordinances was in San Mateo County where they failed, likely as a result of NRA/CRPA litigation threats and the enormous public outcry by pro-gun rights supporters, especially those from the Calguns community.

Despite LCAV’s biased representations of the legal soundness of these ordinances, they are clearly illegal in most instances, and are at best “grey areas” of the law subject to test case litigation in others. Civil rights attorneys from the law firm of Michel & Associates have drafted a letter on behalf of NRA and CRPA contesting the legality of the amendments and served the OCC with the letter.

The letter is available at www.calgunlaws.com as a public document, which means you do not have to register to view it. However, we encourage you to register so we can send you updates on current events in gun law litigation and controversies, as well as informative memoranda addressing legal issues concerning firearms.

Please, before going to www.calgunlaws.com to read the letter, visit the Cal-NRA website and voice your opposition to these proposals: http://calnra.com/legs.shtml?summary=oaklandord&year=2010. Make your voice of opposition heard by the OCC!

And if you live in the Oakland-area and want to attend, the meeting will take place in Oakland City Hall located at 1 Frank H. Ogawa Plaza, Oakland, CA 94612 at 6:00p.m. Please attend and speak out, respectfully.

Update: The California Rifle and Pistol Association ("CRPA") has also weighed in separately on the Oakland amendments issue, submitting a letter to the Oakland City Council offering examples of effective, violence reducing programs that exist as alternatives to LCAV's ill-conceived ordinances. This letter is also available at www.calgunlaws.com along with our opposition letter mentioned above.

Why not post the letters here at CGN, Sean? I think enough paying NRA and CRPA members call CGN home to justify sharing it with everyone.

No problem. I hope everyone enjoys the read. Apparently, the Oakland City Council was not a big fan, but everyone here knows what that can be attributed to. Hopefully, they "re-read" the letter and understand what they are doing is not wise.

I have a feeling they'll be re-reading this after the complaint is filed and hoping to God LCAV didn't just sell them down the river...
