CALNRA: NRA/CRPA Reinstate Expelled Student Gary Tudesko
01/22/2010 10:45 AM - PLEASE DISTRIBUTE WIDELY

Today, the Glenn County Board of Education reversed Principal Mort Geivett and reinstated Gary Tudesko at Willows High School. This represents a victory for law-abiding gun-owners, particularly young adults who wish to enjoy their rights without being hassled by robotic bureaucrats and inane "zero tolerance" policies that would ruin a students record before respecting his Constitutional rights.

Excellent -- the school board just got schooled :)

When I went through the public school system in the 80s, I was deeply concerned at the seemingly-obvious constitutional violations we the students had to deal with on a regular basis. I know now that it's even worse than it was when I went to school, so I'm kind of amazed the outcome is as it is.

This, here, is proof that the NRA is doing things to help preserve our rights. Thanks, guys. :)

That's great news...

Did they give any context to the reversal and reinstatement?

that's great news. this was a rediculous case against an obvious non-threat student. hopefully the principal doesn't hold any grudges against his 'authority' being questioned.

Agreed... that is great news... but it is but a singular victory against "zero tolerance" policies. While certain policies may appear to make sense, they're no replacement for exercising good judgment. Now, once you go back to good judgment type policies, it re-opens the door to potential abuse by school administrators... and ZT policies prevent that kind of abuse while instituting their own abuses...

Insanity at it's best.

Per Paul's promise, the "ruling" or as they called it the "Statement of Decision" by the Glenn County Board of Education is now available on www.calgunlaws.com

It is a public document at this point, which means you do not have to register to view it; however, we encourage you to register so that you can automatically receive updates about what is going on in California gun law.

Once again, thanks to all those who called and sent e-mails and made your voice heard in this matter. It most certainly helped.

Great work team nra. This is a great example of the nra showing up to make a difference. So the kid wasn't a great example in the end. oh well. At least the gun related part wasn't punished. When they expell him for being a racist in a week it won't matter.

Why didn't boyo take the danged gun home before school? Did anyone ask him? With 24 disciplinary referrals to his name, he is likely a big one for pushing rules and seeing what he can get away with, and boy did he get results for his effort. No congratulations or celebrations are in order.

Why the negativity. This could have happened to anyone. The idea is step to up to the lunacy these administrators have created with these zero tolerance ordinances.

I'm sure this kid was happy sitting in class minding his own business.

It seems kind of slimey for the Principle to "air dirty laundry" about the boy on other issues not related to the case.

Seems coercive.

An ad hominem direction against the boy has nothing to do with this case in regards to actions taken by the school which were clearly not legal.

Just want to take a moment to say THANK YOU to everyone who called in, emailed, contributed money, or in any other way assisted the NRA, the CRPA Foundation, and this office in getting Gary Tudesko reinstated to Willows High School. You guys helped us get the ball over the goal line.

Now I just hope the school district realizes it has nothing to gain, and potentially much to loose, by taking this any higher to court. Because if they go to court, Gary can and we will bring his own legal claims.

The school district went to great lengths in the end to smear Gary with a bunch of distorted claims about his disciplinary referral record. That was the most frustrating aspect of this case. None of those referrals were ever serious enough to warrant counselling or other intervention, and none of the referring teachers recommended any further disciplinary action even though they could have simply by basically checking a box on the referral form. Yet when they knew they were losing on the law the district tried to paint Gary as some kind of a violent racist. All of those distorted and borderline defamatory claims could have been countered and explained with evidence that would have made it clear Gary is a good kid, even if he sometimes mouthed off too much in class (reminds me of me at 17). We were ready to do that, but it would have required a trial "de novo." We argued the Board of Education didn't need to take any additional evidence, because there were sufficient grounds to reverse the expulsion without more evidence. The Board agreed, and that's good. But now regrettably the misimpression created by the smear campaign lingers.

Anyhow, thanks again, and especially thanks to Paul Payne, Ed Worley, the CRPA Foundation Board of Directors, and my co-counsels Hillary J. Green and Glenn S. McRoberts.

Next case . . .

Glad to hear it. While a win is a win, I'd rather have our public face be as clean as possible.

ETA: poorly worded. Clearly it isn't, thanks to the hard work of the board. But I at least like to know they're lying about it.

I tweaked that part a bit for clarity.

OK, it is an improvement, but just for the record I was actually saying what *I* wrote was poorly worded and was fixing it with an edit. Still, I like the tweaks.

Just how banally evil do you have to be to try to do what could easily be permanent damage to a kid's reputation because you're tweaked that you got caught with your pants down?

Oh, right, the same kind of evil you have to be to hold victims down by means of the law while someone assaults them. The world makes sense again.
