I was told by a local gun store that if I put my firearm up on consignment and it doesn’t sell, or I want it back I have to pay DROS fees because even though its on consignment it has to go into his books. Is this true?

Sorry, not only you have to pay DROS fees, you will also have to wait 10 days before you can get them back.

You're kidding, right? For consignment, do you actually sell it to the dealer?

No joke. Had the same problem with my Kahr when I put it up. I wanted it back but decided not to when they told me the bad news. In the end it sold and I bought my SA 1911 Loaded.

Why consign anything? Sell it on here for more money and give your fellow calgunners a better deal to boot!

How true!

I just had to find out if it was true or not. In fact, I refused to believe the person who told me this. Guess I owe him a beer now.

The same procedure would be followed if you pawned a firearm and then redeemed it at a later time.

Guys, always remember the Golden Rule:

NEVER SELL a gun to BUY a gun :D !

Everytime I've sold something, I always wish it was back in my collection at some point in the future.

I am a new FFL and I know for a fact if you give me a gun for consignment, I cannot give it back to you until we DROS it (pay $25, or can I charge you a fee to DROS it too?) and you wait your ten days. Welcome to California! :(

Actually, this is a Federal requirement. Consignment or pawned firearms must go through the same background check when they are returned to the owner that regular firearms sales have to go through.

Here are 2 FAQ's from the BATF web site:

(P18) Is the redemption of a pawned firearm subject to the Brady law?

Yes. Unlike the interim Brady law, the permanent Brady law that went into effect on November 30, 1998 does not contain an exemption for the return of a firearm to the individual from whom it was received. Accordingly, the redemption of a pawned firearm is considered a transfer subject to the permanent Brady law.

(P26) Is a licensee's return of a consigned firearm to an unlicensed individual subject to permanent Brady?

Yes.
