Just got into a discussion in another thread about the legality (constructive possession of an SBR) of taking possession of an upper with a barrel length < 16" BEFORE possessing any other AR parts (most importantly the lower.) Basically, if you wanted to build a 16" regular old rifle, but ordered a 14.5" barrel upper and a comp/flash hider from somewhere else and intended to permanently attach it for > 16" compliance. Is that legal?

I know if you had a pistol lower it would NOT be a problem, but what if you had no lower at all? What say the brain trust?

Impactco, feel free to chime in if I didn't clearly state the parameters...

Thanks!

yes it's legal to buy a 14.5inch lower and add a permanent 1.5 inch extension.

in order to build a pistol at least where I go you need all the other parts first and build it there.
