what is the official leagality of tannerite in california? if it is legal then is there any problem using it on blm land?

Buddy, no need to BTT your thread 1 hour later after posting your initial question.

As far as I know, Tannerite has been used on BLM land, however I do not know specifically in writing where it states it is legal.

My impression is that if it were not legal, we would have heard something about it already.

One of my old partners, now a EOD person, responded to a location where Tannerite ws found. If it is harmless substance, he wouldn't have responded.

It's very questionable and I think it matters whether the container it is in is sealed or not.

I hadn't ever even heard of it until this thread so i google'd it. According to www.tannerite.com its still 100% legal in all 50 states. Seems like some fun stuff, certainly not for the kiddies though. Although, I wouldn't consider them saying its legal as sound legal advice.

heck, even The Sportman Guide sells a "tannerite" mixture and doesn't flag it as "no sales to CA" in the latest flyer. But as bwiese? has mentioned, just because they will sell it to you doesn't make it legal.

Since the substance explodes by chemical reaction it cannot be placed into a sealed container. Dry ice and water are legal until you seal them inside of a bottle...then it's a felony.

Binary explosives are still off the radar in the CA PC, do not know how BATF regulates it.

The whole point of binaries are each component is relatively harmless until mixed and after a threshold energy is applied...BOOM

+1 a DA may classify it as a dangerous device, but we'll have to wait and see how that trial goes...

12301(a)(6) PC Any sealed device containing dry ice (CO2) or other chemically reactive substances assembled for the purpose of causing an explosion by a chemical reaction.

Once you place the tannerite in a sealed container you have committed a felony. While the substance is legal you can still make a destructive device from it.

Affirmed...

Tannerite is a binary explosive, when the two components are mixed it is an explosive (H&S C 12000). But it requires an input "threshold" energy in order to explode (to cause the rapid chemical reaction) irregardless of container (sealed, open or none).

If someone mixed it and made it into a weapon, then it is a dangerous device per PC12301.
