View Full Version : Someone is trying to tell me fake cans are illegal?

From my knowledge the DOJ doesn't tell us what is legal, but what isn't legal. I also understand that many people purchase fake cans and use them in California. Is there a thread in here or some information that I can show this guy so that he is more informed? Sadly he is acting very arrogant, but I am not one to throw it in his face.

I.E. to permanently attach to a 14.5" barrel to make over 16"

All it is is a solid barrel extension, so long as it is permanently attached you are good to go.

tell him to cite a penal code section, the silence will be deafening.

But as the other guys have said, the fake can itself is no issue. If your barrel is sub 16", yes the fake can will need to be permanently attached.

1st, as someone else said, laws make things illegal. i am not aware of any laws that specifically make something legal. that's the whole OLL example, they are not specifically deemed illegal, consequently they MUST be legal.
2nd you need to explain to this jackhole that the atf doesn't regulate fake cans, because they are not silencers. the atf also does not regulate what pistol grip you can have on your weapon, because it's an aesthetic, not a functional, issue.
3rd, the guy sounds like a complete tool who is enjoying giving you some trouble.

Let me clear up alot of this FUD... Fake "cans" are not illegal as long as there are no empty spaces withing the 'fake can'. For example many airsoft fake cans are considered suppressor NFA items to BATFE. I suggest you use a barrel extension such as this one: http://www.mfiap.com/smallarms/m4-fake.htm The reason I suggest this is because if you are adding lenght to your short barreled upper this product does not contain any hollow chambers or anything the BATFE will have issues with. So any solid piece "fake can" is GTG, a fake can with any type of hollow chambers within it is not. Hope this helps...:chris:

You are incorrect. It's only illegal if it suppresses sound. Hollow chambers have nothing to do with it. Gas doesn't flow through solid matter.

It's your choice/liberty. Its about constructive possession as in having suppressor parts, i.e., baffles, body etc. No difference, same as NFA items sear, DIAS, F/A selector. If you possess one of these items and have an AR regardless of where these items are stored, it's considered constructive possession. Meaning the items in question are within your control... I'm not a firearms/2A attorney, but like I said...It's your choice, your risk, your liberty, your arse!!!:43:

Tell him that breathing is illegal. After all, there's nothing saying it's legal.

You cannot produce a law that says they are legal. If he knows of a law that says they are illegal it should be him that needs to provide the "proof". I wouldn't waste my time on the moron.

Actually , iirc, the 1st gen airsoft KAC sopmod fake cans were pulled from the market by ATF? As they were too close to the originals - the tubes were hollow and they disassembled

but that is the only instance, oh and ATF also ruled concrete tubes lined with sound deadening material were silencers too.

And make sure you don't have any extra large potatos, 2litre Soda bottles, or too much toilet paper, or god forbid a motorcycle or lawnmower muffler laying around, because these can be illegal too....
