View Full Version : Shotgun magazine limit. Is over 10 legal?

purely hypothetical... Tube fed semi that can hold 11+1. Legal or illegal?
Not that this gun exists or I want it to, I was just curious about the law. I was not sure reguarding shotguns and the a.w. laws.
Thanks for any help.
ps. sorry if this has been covered before. I searched but did not find the answer.

It would be illegal unless you owned it before the large-capacity magazine ban. The only tubular magazines exempt from the ban are for lever-action and .22 firearms.

12020. (a) Any person in this state who does any of the following
is punishable by imprisonment in a county jail not exceeding one year
or in the state prison:
(2) Commencing January 1, 2000, manufactures or causes to be
manufactured, imports into the state, keeps for sale, or offers or
exposes for sale, or who gives, or lends, any large-capacity
(c) (25) As used in this section, "large-capacity magazine" means any
ammunition feeding device with the capacity to accept more than 10
rounds, but shall not be construed to include any of the following:
(A) A feeding device that has been permanently altered so that it
cannot accommodate more than 10 rounds.
(B) A .22 caliber tube ammunition feeding device.
(C) A tubular magazine that is contained in a lever-action

Don't want to spread FUD, I'm just hypothesizing here, but isn't this the same as with handgun mags? What I mean is, every now and again you get a 10 round handgun mag that might squeeze to fit 11. From what I understand this is gray area.

So to play devils advocate....
If I had the parts to make a 11+(or a 15/ 20) round shot gun before the ban I could assemble it and be legal.
if i was law enforcement and exempt I could have the shotgun over ten rounds as long as it is not a detach mag and o.a.l. is 26+ inches long. this would be an aw or sbs? Right?
So it seems to me that the rules are the same as the rifles reguarding magazine limit. With the exeption of the no detachable magazine.
