View Full Version : Question about obtaining an "off-roster" weapon legally.

Hello all,

I am hoping someone can help me with understanding current California gun law for a specific scenario.

I want to purchase my first gun and my first choice is a Walther PPS which is currently not on the roster of approved firearms to purchase in CA. I know there are some exceptions with private party sales and also for transferring a gun within a family but I am not totally clear on this.

My wife has an uncle who lives in Utah. Would it be legal for him to purchase a Walther PPS and then give/transfer it to my wife since they are family? Could she then transfer it to me? If that is legal, what kind of paperwork/fees would there be?

Only if her father/mother and grandfather/grandmother are alive. Intrafamilial transfers in California only travel through direct descendants/antecedents. SO, your wife's uncle would have to give the weapon to his mother or father is either is alive. Who could then transfer the weapon to her.

Don't you just love California law?

No, it would not be legal for your wife's uncle to transfer a non-rostered handgun to your wife. The intra-family exemption is only for grandparent, parent, child, or grandchild, no others.

You might as well just move and start a new life outside of CA - get your first choice for a pistol and even a CCW ~ sounds like you have family in Utah, why not move there?

If you don't like it you can always move back. :cool2:
