View Full Version : Question about transferring an AR15 from my brother

Hi, newbie here on Calguns.net and I love this site. This may have been answered so I hope I am not wasting anyone's time.

My brother has a brand new Colt Accurized Rifle-24" CR6724 that he is willing to sell to me. He lives in Las Vegas, I live in San Diego. He can install the bullet button and it's built on the OLL Colt CAR-A3 HBAR Elite.

My understanding is with this OLL and an installed bullet button this build would be considered legal by the letter of the law. In your opinion, if this is incorrect please let me know.

In your opinion what is the easiest and "most" legal way to take possession of this rifle from my brother in Las Vegas.

Any help would be really appreciated.

assuming the CR6724 isn't on the list of AWs in California he can just ship it to any FFL in CA once the bb is installed. I would STRONGLY suggest that you contact the FFL first to ensure they are "OLL friendly." I'm sure some of our SoCal contingent can clue you in to good FFLs in San Diego.

Your brother sends it to a CA FFL dealer, where you DROS/4473 it and wait 10-days.
The CA FFL dealer can charge any amount to do the transfer.

Rifle needs to be made CA legal (install BB) prior to being shipped to a CA FFL dealer.

Thanks guys. It being my brother in LV and it's a long gun and not a hand gun I didn't know if that changed anything. Thank you for your time!

Can't his brother install the BB, bring it San Diego when he comes to visit, and do a PPT at an OLL friendly FFL? Just wondering how this works with an out-of-state resident selling in CA to a Ca resident.

This is what I was wondering. However, I am finding it difficult to find a OLL "
friendly" FFL dealer. They want me to strip the gun to a bare receiver or they freak out as soon as I mention Colt. I don't know what they would do if I showed up with my brother and the gun.

Is there the possibility of an intrafamilial transfer using a parent or grandparent?
It's a little more time consuming, but no travel would be involved. The forms are on the DOJ page.

Because it's interstate, Feds say it still has to go through FFL, so the skittishness of some of those is still in play.

Presuming it were just an OLL (as we are, here), if the rifle were already in CA a transfer from parent or grandparent would work.

So how is a Colt not on the banned list? I thought "Colt Series" pretty much covered it?

If you go to the banned list of guns from the Kasler vs. Lockyer decision it says "COLT: AR-15 (ALL)*" The asterik references you to the bottom where it says "*Specifically named in the Robert-Roos Assault Weapons Control Act of 1989 and required to be registered by March 31, 1992"

However, if you go to the off list receivers list here on calguns.net it plainly shows the Colt CAR-A3 HBAR Elite as an off list receiver. Why is this is this considered an off list receiver?

Because Harrot v County of Kings clarified that "series" didn't cut it. That, plus the change in the law where DOJ no longer has the legal power to add guns to the 'aw' list, produced the whole OLL phenomenon.

What I didn't realize is that when they created the ban list they listed Colt as a manufacturer and a series of models under it. They first banned all Colt AR-15 models. Colt was making AR-15 and that was their used in their model number such as the AR15-A2 6520. Here is a picture of that receiver:

It clearly says AR-15 A2. These are the models listed by the DOJ, not ALL Colt AR15 types but the models that were stamped AR-15. They later banned Colt Sporter Models, Match Target, & Law Enforcement 6920.

So when these OLL friendly FFL guys tell me that all AR-15 Colts are banned they really don't know their stuff. My brother's Accurized Rifle does not have Match, Sporter, or AR-15 stamped on it. Therefore it is an "off list" receiver. However, finding a FFL that knows about this is hard to come by.

honestly IMO I would just go to a local OLL friendly FFL and buy a Stripped lower. Have your brother send all the colt parts to you, it would only take prob 30 minutes to dissasemble, and then just put all the colt parts on it, then your brother could sell the colt stripped lower there, maybe even sell it first so you have money to put towards your new stripped lower, half the time with all the transfer, dros, and shipping its cheaper to buy a rifle here, plus you dont have to worry about it being Cal legal. There is a list of OLL friendly FFL's floating around here somewere. here are a couple of OLL friendly FFL's in San Diego: Discount Gun Mart 619-276-8730, Southern California Gun 858-571-2020, im sure there is more, I know theres a pawn shop down there that sells Kaiser Defense lowers for like 210.00, just cant remember the name, I just got these off of Uclaplinkers list.
