Nope, not legal.
The statute doesn't require presence of both people but the way the DROS software is written does require both people to be present. I don't think any FFL will do a PPT involving a seller who isn't present.

Other than FFL-exempt situations (C&R rifles, intrafamily, inheritance/ or operation-of-law transfers) the transferor has to show up at the CA FFL for a PPT. That is, unless he shipped the gun to the CA FFL, and the FFL was able to sell it as an dealer-inventoried item (i.e, Roster applicable or exempt) as a non-PPT xfer.
Otherwise, he may not have to show up at the FFL at same time as the buyer (i.e., deal structured as a 'consignment sale') but he has to show up.
