Once they've taken the case, and especially after hearing oral arguments, I don't think they can back out of hearing the case.

I could be wrong but I don't think so.

They can punt on the ruling like everyone else has, or make it so weak it's meaningless. Courts have been doing so on this issue for decades.

Nothing so far today. Maybe they run late occasionally?My observation so far is between 0930 and 1100. And at least once it was one around 10, and another one 1030-ish.

Well, for starters, I imagine that a suit has to be filed against various statutes to challenge their newly-found unconstitutionality following incorporation.

So multiply the number of things you want challenged in court by a factor of 2 weeks...:43:

I was anxiously awaiting the decision of the tree judge panel, but then I realized that it will be a total non-event. Because regardless of which way the panel decides, it will have practically no effect in any way. Whichever way the panel decides, it will not go into effect, it will just be appealed. It won't even have any significant value in predicting how the rest of judiciary will rule, because there is reason to suspect that these three judges might be a coincidental random pick of three pro-gun judges. In essence this will be about the same as the first three votes of a large panel coming back with a decision - it has little meaning and no effect until the rest of the judges come back.

For what little it's worth though, I would guess that the longer it takes (within reason) for the three judge panel to come back, the better it is for us, because it would probably be relatively quick and easy for them to just cite precedent and reject the appeal if they weren't going to incorporate.

We can hope that they think this will be the most significant case of their careers and are trying to make it the most persuasive decision possible. After all, the 2A is almost the only BoR amendment left that doesn't have a huge body of settled case law, and citing precedent isn't "interesting."

The more ambitious they are, the better for us.

yea i guess but everytime theres a new post on a thread named Nordyke and nothing else my heart strings start to flutter. its seems like torture becasue we expected it to be out by now not in May.

I've downloaded and heard the heller case 3 times in entirety the only thing i will be disappointed by is if the nordyke victory doesn't make the front page of the paper cause im keepin that bad boy.

By the time the decision comes out it is entirely possible that printed paper communication will be obsolete and out of use for several years.
