There are some threads around here where the conclusion is the law can't go into effect until about 2026? IF EVER.:)

For now you should assume that microstamping is not legally implementable.

There have been whole threads on it in the past. Basically, if there's any entanglement with proprietary processes the Atty Gen'ls office can't certify its lack of being unencumbered. There are numerous patented marking/etching technologies, esp out of the semiconductor process industry, which encumber the availability of any microstamping implementation.

And the DOJ BoF does not wanna get into the role of patent dispute resolver. They don't have the talent, nor do they have the budget for hiring outside counsel.

Nor the budget to pay the judgments on behalf of the microstamping company that wrote the law, when they lose every patent and IP infringement case that will land on their heads. Which they will... they'd be going up against IBM, Intel, Motorola, Phillips, Matsu****a... they're fighting way out of their weight class.

If the legislation does not provide total liability coverage (on the state's dime) for the "technology provider", then the company needs to get their lobbying fees back. That's SOP in any "everyone must buy company X's product" law.

Of which there are far more than most people realize... Ever been fingerprinted? LiveScan (LiveScam) is a private, for-profit corporation. But if the State of California requires you to be fingerprinted, you must go to LiveScam to have it done, and you must go each and every time you need prints... at 100 bucks a pop. If you got an alarm tech's card and a guard card on two consecutive days, "that'll be $200 dollars please."

Anytime you hear the words "in partnership with the private sector", reach for you wallet... some smart guy has figured out a way to get his grubby little mitts on your tax dollars.

The way the law was written, it can't be implemented.

The law says something about them having to use technology that isn't hindered by a patent (sole source).

The only microstamping technology in existance is patented and only available from one comany.
