OK, let's make this a serious (yet fun) thread on our prediction(s) for the date that the ruling is handed down. maybe the one reply with the most accurate prediction date gets a prize of some kind. Just a suggestion that I thought I'd throw out.:D

The prediction question:

On what date does the 3 Judge panel of the Ninth Circuit U.S. Court rule on Nordyke v. King?

My prediction: April 17, 2009.

I still don't think they will incorporate Heller based on this case.

They may agree that it needs to be incorporated and send it back to be argued including the 2nd A argument.

But I can still hope and pray!

I still don't think they will incorporate Heller based on this case.

Sadly I agree, I think the 9th will make every attempt to punt this up to SCOTUS or try to give the decision to Nordyke without incorporation.

Frankly, I don't think the 9th has the cajones to rule on it AT ALL. I think they'll say that it "needs study" or some such B.S., and they'll leave us with a half-fast answer which is what they always do.

That makes no sense to me. Why would those judges take it upon themselves to pull that case out of the round file to hear the case... only to dodge it?

As much as I want incorporation, something tells me that a lot of people here on Calguns will require some large quantities of blood pressure medication stocked up. I have my hopes up, but I'm also prepared for disappointment and outrage.

Well if it comes on my B-day in March I will have to go out and celebrate twice in the same night. Being that its a win win scenario. Maybe I shall break my one beer limit and get two, one in each hand. ;)

Besides all these Pisces chimed in, I think its only proper an Aries say something. Of course I was born on the cusp.

This. These 3 justices said they didn't like the previous ruling they were forced to hand out, and they said so. They pulled this out of the garbage can and dusted it off after Heller - why? Not to shoot it down again. I'm not an expert on the laws, the courts, this case, etc but I can read between the lines enough to know that something's up and these 3 have something in mind.

ETA: Is there a semi-legit rumor mill about this court that we can listen to and chatter about? Or are we just going to have to sit here in the dark until it's sprung on us?

That is exactly my point. The person I quoted said he thought they would dodge the issue. I highly doubt they would pull it from the trash simply to dodge it.

His opening one word sentence "This." was a sign of agreement. The rest was simply his own rewording and expansion on your statement.

FWIW: The court doesn't have an option of "not ruling."

This would depend on what your definition of the word this is.
