I was buying a new CZ75 Compact on Saturday and another fellow was doing a transfer. He said he did not have a HSC but that the DD214 he has showing honorable discharge is a satisfactory document to exempt him from the HSC.

Is this right?

There are 3 exemptions for military. Active Duty, Reserve, and Retired. Honorable discharge is just honorable discharge.

X01 = Special Weapons Permit Holder
X02 = Operation of Law Representative
X03 = Handgun being returned to the owner
X13 = FFL collector with COE (curio and relic handguns only)
X21 = Military - Active Duty
X22 = Military - Reserve
X25 = Military - Honorably Retired
X31 = Peace Officer - California - Active
X32 = Peace Officer - Federal - Active
X33 = Peace Officer - California - Honorably Retired
X34 = Peace Officer - California - Reserve
X35 = Peace Officer - Federal - Honorably Retired
X41 = Carry Concealed Weapon (CCW) Permit Holder
X81 = P.O.S.T. 832 PC (Firearms) Training
X91 = Particular and Limited Authority Peace Officers
X95 = Law Enforcement Service Gun to Family Member

FUD has a specific connotation - deliberate misinformation, inspiring Fear.

This guy just was wrong.

Don't cheapen the language any more; it's impoverished as it is.

I guess this means I have to ask what the exact definition of FUD is.

Take it easy on the guy. It was legal a few years ago for a DD214 to work. The state then change the rules and required a HSC. It is not FUD, just out dated info.

FUD = Fear Uncertainty Doubt

So if the person is saying things that are wrong AND is trying to use one of the above tactics to reinforce that falsehood then they are engaging in FUD.

Well actually, after you get out of active duty one is on a status called Individual Ready Reserve (IRR). So it could possible fall under the x22 exemption, right?

You are only automatically entered in the IRR if you get out before serving 8 years.

If I did 4 and got out, I would have 4 more in the IRR. If I did 9 and got out, I am simply 'out'.

I don't think you get an ID in the IRR so I am not sure how to prove it, I think the law is for Active Reserves.

It was ok when I got my handgun.. I fell under x25
but now something "magically" changed and I cant.

I don't doubt your experience, but that's peculiar.

You did 20+ (or whatever) and actually retired? And you can prove that? Then X25 applies as an HSC exemption.

When it was the lifetime BFSC (1993-2003), if I recall correctly, the exemption was 'prior service'; the HSC changes did change that to 'retired'.

I used my DD214 to buy a lot of guns until they changed the law. Then I got an HSC, which took about 5 minutes. It's just the state nickel and diming us to death.
