View Full Version : Transferring OLL to Father-in-Law

Hello all,

I tried searching, but got a slew of information that wasn't exactly relevant to my dilemma.

I would like to give one of my OLL's to my father-in-law, but I don't know what hoops I have to jump through in order to do it legally.

We both live in the state of CA, and he is not a felon, nor does he have anything on his record that would prevent him from owning a firearm.

How do I go about giving him the OLL?

There are two ways to do it.

#1.
You and your father-in-law go to a CA FFL dealer and PPT the rifle.
It gets DROS'd, 10 days later, your father-in-law picks up the rifle at the FFL dealer.

#2.
You gift the rifle to your wife.
She then gifts the rifle to her dad (your father-in-law).
Your father-in-law enjoys his new rifle.

What is involved with "Gifting" a firearm? Is there any paperwork that needs to be done?

If you want to give an OLL to your father-in-law then you need to do a PPT through an FFL in California. You both go to the Dealer for the transfer and the maximum fee is $35.

If your wife lives in California too then she can just give an OLL to her father with no paperwork or Dealer or fees or waiting period. You can also give an OLL to your spouse the same way.

But you giving an OLL to your spouse so that she can then give it to her father is against the law if you are doing it to avoid the PPT at a Dealer.

No paperwork involved for long guns (rifles/shotguns).
Paperwork and fee involved for handguns.

Gifting involves...

Handing firearm to recipiant. "enjoy this present/gift".
Recipiant accepting firearm. "thanks for the present/gift".
Everyone has a good time. :D

Awesome...Im definitely not avoiding the PPT...im going to give it to my wife...and if she doesn't want it...she can give it to her father!!!

...oh and a sidenote...I haven't been here for quite some time, and I see a lot about this Nordyke...I tried reading up on it and cant quite grasp why its a big deal...it seems like it's just pertains to gun shows on public ground or something to that effect...so why is everyone so excited!

If your wife is shopping for an OLL as a gift for her father then it would be perfectly legal for her to acquire an OLL from you for that purpose.
