Joe owns 20 legally acquired full capacity magazines of various calibers, all of which hold more than 10 rounds.

Jane owns 30 legally acquired full capacity magazines of various calibers, all of which hold more than 10 rounds.

Joe and Jane are not related and reside in CA.

If Joe and Jane trade some of their legally acquired full capacity magazines between themselves (each trading the other for “new” calibers or types not previously owned) so that Joe and Jane end up with 20 and 30 magazines, respectively, has a crime been committed?

Is pre-ban ownership of magazines: type, caliber, capacity and/or “count” specific, or simply "date of purchase" specific?

Yes it is illegal

the law means the EXACT magazines you had, pre ban. doesn't matter if they're related, both are comitting a crime (giving). i brought up an interesting "what if" a while back. are pre ban mags community property? say aquired during a marriage but before the ban.

They should both "Toss Out" a few magazines. If the other person "Finds" them they are legal to keep. The law has no restrictions on finding standard-cap mags.

boy this one brings up some interesting scenarios


say all the magazines are identical they pour all the magazines into a bin stir it around and cant tell who belongs to which magazine what then?

repair is allowed as long as the maga zine functions in the same firearm

so mary has a 20 rounder ar-15 and mike has a 30 rounder

can mike take a rebuild kit dissassemble his 30 rounder

build up the repair kit he now has one say p-mag 30 and a gi 30 round kit now

he hands the "30 round gi kit" to mary she dissassembles her 20 rounder and builds up the gi 30 kit to repair her origional 20

she hands the origional 20 rounder "kit" back to mike and he rebuilds his p-mag with the 20 rounder kit

he now has a 20 round origional and the p-mag rebuild kit

so it appears that he traded his 30 rounder to mary for her 20 rounder

was that legal?

If you repair or alter a high-cap, it still needs to work in the original gun in the original caliber, so NO, you can't trade high caps in different calibers.

where does it say it has to work in the same caliber?

Well, obviously, this shows the difference between "against the law" and "something you can be put in jail for". More specifically, if you and I had the identical model of high-cap magazine we bought back in '99, and we trade them, we have both just broken the law. It's obviously unlikely we'll either be prosecuted if that's all we do, however.
