View Full Version : Open magwell in a BB configuration a no-no?

I read this in the AR/AK memo (http://www.calguns.net/copmemo2.pdf) linked on the front page of Calguns

To be legally safe in California, an off-list AR15-type lower receiver should never have a pistol grip or telestock, etc. attached unless and until a nondetachable (fixed) 10-rd magazine is already affixed. When repairing or dismantling such a rifle, features such as pistol grips, telestocks, etc. must first be removed before removing the fixed 10-rd magazine.

I was under the impression you could remove the mag as long as you need a tool to remove it. I am misinterpreting this paragraph?

portions of that memo have been obsoleted by the BB.

An open magwell with a bb is ok since only has the capability of accepting an attachable magazine, not a detachable magazine.

that memo is out of date and a very cautious reading of the law back when the BB first came on the scene. search, and you will find many threads that discuss this, but the general consensus here is that the magazine is not detachable without a tool, so it meets the letter of the law. attachable magazines are not against the law, just detachable.

FWIW, I whipped out a complete lower - pistol grip & collapsing stock, OEM mag release, no BB, NO UPPER, in front of a DOJ field agent and he didn't bat an eye.

:D

I think a BB rifle w/ no mag is OK.

after reading that. you then need to go read the legal definition of a "fixed mag"

That memo pre-dates the Bullet Button and only refers to Prince50 type rifles.

Bill Wiese, who wrote it, would tell you it's no longer the correct interpretation for a BB equipped rifle.

Also, it suffers from hyperconservatism, as it doesn't account for separation of the upper/lower instead of removal of evil features from a P50 build.
