So I have called the security company that employs the guards that illegally detained me the other day for OC and on the third time in two days of calling I finally got word that the Human Resources Representative for the company has been informed of my situation and will be getting back to me in short order! I can hardly wait to hear the outcome of this.

Better yet will be if the mall has no statute about weapons in the mall and the security guards were trying to enforce a rule that doesn't exist.

I'll keep you guys posted!

What? Can you post the thread, if you made one, that talks about the original event?

I thought you were from Escondido, was this at North County Fair? Too crazy, tag.

Actually, Security Guards cannot legally detain you. Only LEO can detain. If a Security Officer stops you and won't let you leave, he has arrested you. If you are not charged/convicted of a felony, it is illegal arrest. I know this because I am a security officer and they made sure we understood this. You could even have charges brought and sue if you wanted.

The only problem with this is::::::: Most "security guards" are pos that do not have any assets. That means that should you sue them personally, you would get nothing but a piece of paper. Include the mall, security company, etc. in your law suite. I'm to the point that if I'm faultlessly arrested you will find that assh*les body in the desert. I don't do illegal and I'll be damned if some lowlife-wannabee will put a stain on my record.

Calm down man :) A lot of these guys are just ordinary folks trying to put food on the table like everyone else.

I don't think you were falsely arrested, but you may have been kidnapped.

You may also arrest for misdemeanors and infractions, as a citizen or security officer/guard. Your company might just make it a felony only rule.
And it's a false imprisonment, not an illegal arrest.

you have to have seen the misdemeanor / infraction to arrest, but a felony you can arrest regardless if you witnessed the crime. i thought thats how it works for non- LEO?
