View Full Version : Questions regarding HSC exemptions..

I just sent in the report of interfamily transfer of a handgun. The form didn't ask for an exemption code or HSC number. I currently hold a valid Level III reserve certificate, however I am not currently hired as a Level III reserve. I am correct in assuming that I am exempt from the HSC requirement? If not I better get my butt down to the range and get my HSC.

Also,
I am curious, does the Level III certificate entitle you to any other firearms excemptions? (I.E. large cap mags, or age excemptions from the 21 and older handgun law)

Level III is PC 832 (firearms and arrest) or higher so you are good for a HSC exemption, but III reserves do not have full police time police powers and must be issued a CCW from the hiring department if to carry off duty unless you are going direct to and from work.

Being a certified POST level III that is not working for a department doesn't give you any real perks, At least that is how I understand it.

No.

And being level II or I certified without being in a LE department does not give you any exemptions either.

Weak.. Well, being hired is gonna change soon.. I am working my butt off to try to get in the door with a department.

At least I am exempt from the HSC, that's off my mind.

Just make sure that you can show a dealer that Level III Reserve training includes PC 832... As it is, I'd imagine that many Dealers do not see PC 832 Firearms training certs very often and may not be familiar with that exemption, let alone having a related exemption... X91 = Particular and Limited Authority Peace Officers

The X91 exemption, IIRC, is for corrections officers, parole/probation officers and the like.

My girlfriend did a interfamily transfer and she never got her hsc? I dont think the form she sent into the doj said anything about it either. It was just done too.

Do I need a Handgun Safety Certificate (HSC) if I am receiving a handgun from my mother or father?

Yes. Prior to taking possession of the handgun, you must havea valid Handgun Safety Certificate (HSC). You must also report the transfer to DOJ, pursuant to Penal Code section 12078(c)(2)(A), within 30 days of the transfer. Any 832PC course certificate will get you HSC exemption, but not 10-day wait exemption. Show the FFL your 832PC (POST III) certificate, they probably will take a copy and you should be good to go.

Yes, I know that Level III includes PC832 but I've been in shops where the dealer wondered if Level III Reserve training qualified for the PC 832 exemption... Somewhere there is a chart that shows what firearms training each POST level gets, from 832 on up to RBC/Level I as well as SIBC training.

Oh, yeah, the X91 exemption also includes public officers that are armed and function under PC 836.5... There are very few of those.

I have used my 832pc firearms training certificate as an exemption for the HSC on multiple occasions. The X81 exemption code should be used by a dealer. FYI, there is no time limit on when the training took place, just as long as you provide the original certificate... mine's dated in 1993.
