View Full Version : What Happened to Effort to Define "Capacity to Accept"?

I've been away from the board for awhile. What happened to the efforts to amend the CCR to define "capacity to accept detachable magazine"? I recall that went down in flames and there was some effort to rewrite the definition. What happened (if anything)? Thanks.

The DOJ abandoned the redefintion of 'detachable magazine'. After all the drama, they did not submit the proposed regulatory redefinition to the Office of Administrative Law by the required date.

A further effort by Gene Hoffman & Oaklander with OAL made DOJ pull the proposed regulation from the DOJ BoF website - even after the DOJ abandoned it, they left the material on the DOJ BoF website to have the effect of an 'underground regulation'.

Thus, there has been no change - the regulatory definition of 'detachable magazine' in 11 CCR 5469(a) has remained the same.

The interesting part is that DOJ's attempt to "surrender" may in and of itself be an underground rulemaking...

That was the funniest part - they just couldn't stop themselves from spreading more FUD - even when they got spanked!

With the help of hoffmang, oaklander and bwiese, DOJ realized it was exceeding it's authority to create regulatory law and abandoned the effort.

[Marine DI]Amazing[/Marine DI] This .gov doesn't get it, they are like my 6 y/o son and need a checkmate every month.

The list Ben has for those who made things happen needs to be bigger...my name should be on it as well. I hope to be back in the mix asap.;)

Divorce my man...I moved to NV last July or so and now that the ex and her dirtbag boyfriend are out of my house im trying to get ready to get my old job back @ att.

Ive bought a few NFA items and would like to ad a M16 receiver to the list before returning, the NFA stuff will stay in NV but its only 3 hours away.

I wish I had a few more bucks in my pocket, a STI pistol would be nice before coming back but Im strapped for $$ right now.
